A blogger who was threatened by Associated Press lawyers into shutting down his blog, because he allegedly violated AP’s copyright in its photos, is now pissed off that the AP feels free to publish Ashley Alexandra Dupré’s photos without her consent.
My take on the blog was that the blogger probably was within the Fair Use Doctrine (because he was criticizing the editorial content of the photos in order to demonstrate media bias), but probably means it’s litigable, and the AP has deep pockets to litigate while the blogger was doing his blog as a hobby. Thus we see that the AP uses its lawyers to kick around the little guy while committing the exact same transgressions it accuses others of.
Regarding Ashley, I say that the public had a right to know what she looked like. That’s a moral opinion and not a legal opinion.
I've always wondered how AP became such a hegemonic powerhouse of wire service news. There should be competition in this space. Too bad UPI died. And reuters is British, it doesn't count.
